Terms of Service
Last updated November 2, 2026
These Terms of Service (the “Terms”) are an agreement between you and Creative Advisor LLC (“Creative Advisor”, “we”, “us”, “our”). They govern your use of:
- our website at www.creativeadvisor.com and our blog at www.creativeadvisor.com/blog (the “Site”); and
- our app at app.creativeadvisor.com, including Press Room, Brand Manager and First Pass (the “App”).
Together these are the “Services”.
Agreeing to these Terms
- By using the Services, or by creating or accepting an invitation to an App account, you agree to these Terms.
- If you use the App for an organization, you agree on its behalf and confirm that you have authority to do so. “You” then includes that organization.
- If you don’t agree, don’t use the Services.
If you have a signed agreement
- If your organization has signed a separate agreement with us for the App (for example an order form or master services agreement), that agreement controls wherever it conflicts with these Terms.
Our Privacy Policy explains how we handle personal information.
Please read section 17. It says disputes are resolved by individual arbitration, not in court or as a class action, and that claims must be brought within one year. You can opt out of arbitration within 30 days.
1. The Services
The Site describes our services, lets you book a call, lets you join the App waitlist, and publishes articles.
The App helps PR agencies and in-house teams earn media coverage and visibility. It includes:
- Press Room: tools to find media opportunities for clients, track pitches and coverage, keep a knowledge base (“Memory”) and press kits, and share opportunities with clients through a client portal;
- First Pass: drafting of social posts in a person’s own voice; and
- Brand Manager: tracking how AI answer engines describe a brand or person.
Changes and availability
- We’re actively building the App. Features may change, be added or be removed.
- We may switch tools on or off for a workspace. Your data stays when a tool is switched off.
- Some features are marked beta or early access, and the whole App is pre-launch. These are provided as-is, may contain errors, and may change or end without notice.
2. Eligibility and accounts
Who can use the App
- The App is for business and professional use. You must be at least 18 and able to form a binding contract.
- App accounts are currently by invitation only. Joining the waitlist doesn’t guarantee an invitation.
- We operate the Services from the United States. If you use them from somewhere else, you’re responsible for complying with the laws that apply there.
Your account
- Give us accurate information and keep it up to date.
- Keep your password confidential. You’re responsible for everything that happens under your account.
- Tell us right away at support@creativeadvisor.com if you think someone has accessed your account without permission.
- Each account is for one person. Don’t share logins.
3. Workspaces, roles and client portals
Workspaces. The App is organized into workspaces. A workspace belongs to the organization that set it up (the “Customer”). An agency workspace holds an agency’s staff and its clients. A team workspace holds one company’s internal team and brands.
Roles
- Workspace members have roles (Owner, Admin, Member) that decide what they can do.
- Owners and Admins can invite and remove people, and can delete client records.
- The Customer is responsible for who it invites and for what its members do in the workspace.
Client portals
- An agency can invite its clients to a client portal. If you join as a client, you’ll see what your agency shares with you.
- Everything you enter in the portal is visible to your agency’s staff, including draft responses, comments, press-kit details, coverage and Memory content.
- Your agency, not Creative Advisor, provides PR services to you. Your relationship with your agency is governed by your agreement with them.
If you leave a workspace or delete your account
- The workspace keeps the content that was added to it, including records about you as a client.
- To have that content deleted, ask the Customer, or ask us and we’ll pass the request on. See the Privacy Policy.
Agencies’ responsibilities to their clients. If you’re an agency, you confirm that:
- you have your clients’ permission to put their information into the App;
- you have given them any notices the law requires; and
- you will handle their requests about that information.
4. Your content
What “Customer Content” means. Customer Content is everything you or your workspace’s members submit to the App, plus the results the App generates from it (“Output”, see section 5). Examples of what you submit:
- client profiles, bios, press kits, headshots, notes, drafts and comments;
- transcripts, articles and social posts;
- spreadsheets and coverage records; and
- tracked questions.
You own it. As between you and us, the Customer owns its Customer Content.
Permission you give us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, analyze, transmit and display Customer Content, and to create works derived from it, as needed to:
- provide, secure and support the Services;
- improve and develop the Services, as described below;
- prevent abuse; and
- comply with law.
This licence includes sending Customer Content to the service providers listed in our Privacy Policy, such as AI providers, for those purposes.
Usage Data. We also collect information about how the App is used: for example which features are used, clicks, accept and reject choices, ratings, match outcomes, timings and errors (“Usage Data”). Usage Data isn’t Customer Content, and we may use it for any of the purposes in this section.
How we learn from use of the App. We may use Usage Data, and Customer Content in aggregated or de-identified form, to improve and develop the Services. For example, we may:
- analyze patterns and trends across workspaces to improve the App’s features, defaults and recommendations;
- create benchmarks and aggregated data (see section 9); and
- train and evaluate our own models and features on Usage Data and aggregated or de-identified data.
Training on your identifiable content is opt-in. We train our own models on your identifiable Customer Content only if you opt in, for example in a signed agreement or data processing agreement with us.
Our commitments. Whatever plan you’re on:
- We don’t share your Customer Content with another customer, or tell other customers which questions you track or which clients you work with. Features that learn from many workspaces are designed not to reproduce one customer’s content in another customer’s results.
- We won’t publish anything that identifies you, your organization, your clients or any person without your permission.
- Our AI providers’ terms don’t allow them to train their models on Customer Content.
- We never sell Customer Content.
Matching across workspaces. One App feature matches incoming journalist requests against clients in multiple workspaces. To make it work, short client profiles from different workspaces are processed together by our AI provider. The feature is designed so each workspace sees only matches for its own clients. By using that feature you agree to this. See Privacy Policy section 5.
Your responsibilities. You confirm that:
- you have all rights and permissions needed to submit Customer Content and to let us use it as these Terms describe;
- your Customer Content and your use of the App comply with the law, including privacy, data-protection, anti-spam, intellectual-property and publicity laws; and
- you won’t submit sensitive information that the App isn’t designed for. Examples are government ID numbers, financial account numbers, health information, or information about children. If you do, it’s at your own risk.
Personal information in your content. If Customer Content includes personal information, our handling of it is governed by our Privacy Policy and, if you have one, our data processing agreement with you. The Customer is responsible for having the right to collect it and to let us use it as these Terms describe, including under its agreements with its own clients.
Removing content. We may remove or disable Customer Content if we reasonably believe it breaks these Terms or the law. Where practical, we’ll tell you.
5. AI features and Output
What Output is. Many features use artificial intelligence, including third-party AI models. They produce results such as:
- opportunity matches, fit scores and suggested angles;
- summaries and Memory facts;
- research results and contact details;
- drafts and coaching notes; and
- analysis of AI answer engines.
These results are “Output”.
Output can be wrong. AI makes mistakes. Output may be inaccurate, incomplete, outdated, biased or inappropriate. It may misattribute facts or invent details, including names, quotes, sources and contact information. You are responsible for:
- reviewing Output before you rely on it;
- checking facts, sources and contact details;
- making sure anything you publish or send is accurate, lawful and yours to use; and
- complying with any rules on AI-generated content that apply to you, such as an outlet’s rules or a platform’s disclosure rules.
Output isn’t professional advice. It isn’t legal, financial or other professional advice.
No guaranteed results. We don’t promise any specific outcome. That includes media coverage, bookings, interviews, replies from journalists, follower growth, or how AI answer engines describe or rank you. Opportunities and journalist requests come from third parties and may be inaccurate, expired or withdrawn.
Ownership of Output
- As between you and us, and to the extent the law allows, you own the Output generated for your workspace. It is part of your Customer Content.
- Other users may receive similar Output, because AI can produce similar results for similar inputs. Output generated for others isn’t yours.
Voice and writing analysis. First Pass analyzes a person’s writing to imitate their voice, and can describe their writing style and tendencies. Only use it for a person who has agreed to it, and only to draft content for them to review and publish themselves.
6. Research, monitoring and third-party services
How Brand Manager works. Brand Manager sends the questions you track to AI services and records their answers. It reaches those services through their official APIs (and, for Google AI Overviews, through licensed search-data providers). It doesn’t use anyone’s personal accounts.
- Answers vary by time, location and model version. Results show what a service returned when we asked. They don’t predict what any person will see.
- We have no affiliation with OpenAI, Google, Anthropic or any other AI service, and none of them endorses us. Their names are their trademarks.
How research features work. The App’s research features search publicly available web pages, such as podcast directories and show pages. They also use journalist requests published through PR-request services. Contact details and other information about people in research results may be wrong or out of date.
When you contact people the App surfaces. The App does not send email for you. If you reach out to journalists, hosts or others it surfaces, you’re responsible for doing so lawfully and respectfully. Pitching journalists, hosts and producers about stories, guest spots and other opportunities relevant to their work is what the App is for. That means:
- pitching people individually about things relevant to their beat or show;
- following the anti-spam and privacy laws that apply to you, such as CAN-SPAM;
- respecting the terms and pitching guidelines of the PR-request services and outlets involved; and
- honoring requests to stop contacting someone.
Third-party services and links
- The Services rely on, and link to, services we don’t control. These include AI providers, calendar and email apps, PR-request services, and websites linked from the blog.
- Their own terms and policies apply when you use them. We aren’t responsible for them.
- Some blog links are paid partnerships. We may earn a commission if you buy through them, and we use tracking links to measure those referrals (see our Privacy Policy). Partnerships don’t decide what we write; see “How we make money” and our editorial guidelines on the blog.
Blog content
- Blog articles are for general information. They aren’t legal, financial or other professional advice.
- Product details, prices and offers change, and articles may contain errors or be out of date. We may correct or update them at any time.
- Mentioning a product, service or company isn’t an endorsement of it.
- You’re welcome to link to our articles. Don’t frame our pages or suggest that we endorse you.
7. Acceptable use
You won’t, and won’t help anyone else to:
- break any law or anyone’s rights, including privacy and publicity rights;
- use the Services to send spam or untargeted mass email, or to harass, threaten, dox or stalk anyone, including journalists and media contacts;
- submit content that is defamatory, deceptive, hateful, sexually explicit, or that infringes intellectual property;
- impersonate anyone, or use First Pass or other features to create content attributed to a person without their permission;
- use Output or contact information to build or sell contact lists, databases or competing products;
- use contact details from the App for anything other than pitching people about opportunities relevant to their work, for example sales prospecting or adding them to marketing lists;
- add information about journalists, hosts or other people that isn’t public, professional information;
- scrape, crawl or extract data from the App by automated means, except through features we provide;
- reverse engineer, decompile, or try to obtain the App’s source code, models or prompts, except where the law allows this despite this restriction;
- probe, scan or test the security of the Services without our written permission, or get around access controls, usage limits or tool switches;
- access another workspace’s data, or share your account;
- upload malware, or interfere with the Services or other users;
- use the Services to develop or train an AI model; or
- use the Services in a way that would breach the usage policies of our AI providers (for example, to generate deceptive political content or to make decisions about people’s eligibility for jobs, credit or housing).
We may investigate violations and act on them, including by removing content or suspending accounts.
8. Emails and communications
- Service emails. We send App users emails about their account and workspace activity, such as invitations, sign-in links, password resets and notifications. You can turn off notification emails with the link in them. Account and security emails are part of the service.
- Agency branding and copies of content. Notification emails show the agency’s name and may include the text of drafts and comments. The agency can see what its members and clients send.
- Electronic notices. You agree that we can give you notices electronically.
9. Aggregated data and research
- What it is. We may create aggregated, de-identified data from use of the Services, including from Customer Content and Usage Data, such as statistics about media opportunities, outreach, AI visibility and feature usage.
- How we use it. To operate, improve and develop the Services, to give customers benchmarks and insights, and to publish research and reports, such as data studies on our blog.
- What it won’t do. Aggregated data won’t identify you, your organization, your clients, any brand or any person.
- De-identified means we’ve taken reasonable steps so the data can’t be linked to a person, customer or client. We commit not to try to re-identify it, and we require anyone we share it with to make the same commitment.
- Who owns it. We own aggregated and de-identified data. It isn’t Customer Content, and it isn’t deleted when you leave.
10. Feedback
If you send us ideas or feedback, we may use them without restriction or payment to you.
11. Our intellectual property
- We and our licensors own the Services, including the software, design, text, graphics, logos and the “Creative Advisor” name and the names of the App’s tools. These Terms don’t transfer any of those rights to you.
- While you comply with these Terms, you may use the App for your internal business purposes.
- Blog articles are for your personal, non-commercial reading unless we say otherwise.
Copyright complaints. If you believe content on the Services infringes your copyright, send a notice to legal@creativeadvisor.com with:
- the work you believe is infringed;
- the infringing material and where it is;
- your contact details;
- a statement that you have a good-faith belief the use is unauthorized; and
- a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act.
12. Fees
The App is currently free during early access. If we introduce paid plans, we’ll tell you before you’re charged, and pricing, billing, renewal and refund terms will be shown when you choose a plan or in your order form. We won’t charge you without your agreement.
13. Suspension and termination
Ending your use. You can stop using the Services at any time. You can delete your App account from the Account page. To close a whole workspace, its Owner can contact us at support@creativeadvisor.com.
When we may suspend or terminate. We may suspend or terminate your access if:
- you materially breach these Terms;
- your use creates a security or legal risk;
- we’re required to by law; or
- we stop offering the App.
Notice. Where reasonable, we’ll give you notice and a chance to fix the problem first. If we end the App, or close an account without cause, we’ll give at least 30 days’ notice and refund any fees you’ve prepaid for the time after your access ends.
After termination
- Getting your data out. For 30 days after a workspace is closed (unless closed for a serious breach), its Owner can ask us for a copy of its Customer Content. After that, we keep it, so the workspace can be reopened, until the Owner asks us to delete it. We’ll delete it from our active systems within 90 days of the request, and from backups as they expire (see our Privacy Policy).
- What isn’t deleted. Aggregated and de-identified data (section 9), and improvements to the Services we’ve already made, including models already trained as section 4 allows, aren’t deleted when a workspace closes.
- What survives. Sections 4 (your responsibilities and our commitments), 5, 7, 9 to 11, and 14 to 18 survive termination.
14. Disclaimers
THE SERVICES AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS:
- WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY;
- WE DON’T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE;
- WE DON’T WARRANT THAT OUTPUT, RESEARCH RESULTS, CONTACT DETAILS OR THIRD-PARTY OPPORTUNITIES WILL BE ACCURATE, COMPLETE OR CURRENT; AND
- WE DON’T WARRANT THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
Some jurisdictions don’t allow some of these disclaimers, so some may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- No indirect losses. NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THIS INCLUDES LOST PROFITS, REVENUE, GOODWILL OR DATA, EVEN IF THE PARTY WAS TOLD THEY WERE POSSIBLE.
- Cap on our liability. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM; AND
- (B) US $100.
These limits don’t apply to:
- your obligations under section 16;
- your breach of section 7; or
- liability the law doesn’t allow to be limited, such as for fraud, or for death or personal injury caused by negligence.
16. Indemnity
You’ll defend and indemnify Creative Advisor and its officers, employees and contractors against third-party claims, and the resulting losses and reasonable legal fees, arising from:
- (a) your Customer Content;
- (b) your use of the Services in breach of these Terms or the law; or
- (c) for agencies, a claim by one of your clients about your use of their information.
We’ll notify you promptly of any such claim and let you control the defense. You won’t settle any claim in a way that admits fault for us, or imposes obligations on us, without our consent.
17. Governing law and disputes
These Terms are governed by the laws of the State of New York, excluding its conflict-of-laws rules. The Federal Arbitration Act governs the agreement to arbitrate below.
Talk to us first. Before starting arbitration or a claim, each party agrees to try to resolve the dispute informally for 30 days after written notice. Send yours to legal@creativeadvisor.com and to our mailing address in section 19.
Arbitration. If we can’t resolve a dispute informally, it will be resolved by binding individual arbitration, not in court.
- The American Arbitration Association (AAA) runs it, under its Commercial Arbitration Rules, or its Consumer Arbitration Rules if you use the Services as a consumer.
- The arbitration takes place in New York County, New York, or by video if both parties agree.
- A court with jurisdiction can enter the arbitrator’s decision as a judgment.
Exceptions. Either party may:
- bring an individual claim in small-claims court; or
- ask a court for an injunction to protect its intellectual property or confidential information.
No class actions. Disputes are resolved only on an individual basis. Neither party may bring or take part in a class, collective or representative action, or a class arbitration. If this waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
Opting out of arbitration. You can opt out within 30 days of first accepting these Terms. Email legal@creativeadvisor.com with your name, the email address on your account, and a clear statement that you’re opting out. Opting out doesn’t affect the rest of these Terms.
Courts. Any dispute that isn’t arbitrated, including if you opt out, will be resolved only in the state or federal courts in New York County, New York. Both parties consent to those courts’ jurisdiction and, as far as the law allows, waive any right to a jury trial.
One-year time limit. Any claim relating to the Services or these Terms must be brought within one year after it arises, or it’s permanently barred, unless the law requires a longer period.
18. General
- Changes to these Terms.
- If we change these Terms, we’ll post the new version and update the date above.
- For material changes, we’ll give at least 30 days’ notice before they take effect: by email or in the App for App users, and on the Site for others.
- Continuing to use the Services after the change takes effect means you accept it. If you don’t agree, stop using the Services and delete your account.
- Changes required by law, or that only add new features, can take effect immediately.
- Changes don’t apply to disputes that arose before they took effect.
- Entire agreement. These Terms, the Privacy Policy and any signed agreement or order form are the entire agreement between us about the Services.
- Assignment. You may not transfer these Terms without our consent. We may transfer them in a merger, acquisition or sale of assets.
- Severability and waiver. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term isn’t a waiver of it.
- Force majeure. We aren’t liable for delays or failures caused by events beyond our reasonable control. Examples are failures of third-party AI, hosting or internet providers.
- California users. Under California Civil Code §1789.3, California users can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210.
- Export and sanctions. You won’t use the Services in breach of US export controls or sanctions.
- Independent parties. We’re independent contractors. These Terms create no partnership, agency or employment relationship.
